After Nationals of the Republic of China Have Lost Their Nationality with Approval, How Should They Apply for Restoration of Nationality?

I. Application Procedures for Restoration of Nationality:

According to Paragraph 1 of Article 15 of the Nationality Act, a person who has lost the nationality of the Republic of China and who currently has a domicile within the territory of the Republic of China, and who meets the requirements of “good moral character with no criminal record as evidenced by a police criminal record certificate” and “possessing sufficient property or professional skills to be self-supporting, or having no concerns regarding livelihood security,” may apply for restoration of the nationality of the Republic of China. The applicant (for minors, their legal representative) shall personally apply to the household registration office at the place of domicile within Taiwan, which will forward the application to the municipality or county (city) government and then to the Ministry of the Interior for approval.

II. Required Documents:

An applicant for restoration of nationality shall complete an application form and submit the following documents:

  1. A valid Alien Resident Certificate (ARC) or Alien Permanent Resident Certificate (APRC).
    (Please apply at the service center of the National Immigration Agency, Ministry of the Interior, at the place of residence.)
  2. Police criminal record certificate issued by the applicant’s country of former nationality or other relevant supporting documents:
    (1) The certificate shall be issued by the government of the country of former nationality within six months prior to the application date. If, after the issuance date, the applicant has entered Taiwan and subsequently departed for a considerable period of time, and the competent authority deems there to be doubts, the applicant may be required to submit a certificate of no criminal record for the period of departure.
    (2) If the applicant is the spouse of a national of the Republic of China, the purpose of residence stated on the ARC is “family reunion (husband or wife),” the applicant is under 14 years of age or entered Taiwan before reaching the age of 14 and has not departed again, this document may be exempted.
  3. Proof of sufficient property or professional skills to be self-supporting, or proof of no concerns regarding livelihood security (including income or property of a spouse, the spouse’s parents, or the applicant’s parents who have household registration in Taiwan and do not receive social assistance). (Applicants’ accompanying minor children applying for restoration together, or holders of an APRC, may be exempted.) Submit one of the following documents:
    (1) Domestic income, tax payment, movable or immovable property information (if an “Authorization for Income and Property Inquiry” is provided, the household registration office may inquire with the Ministry of Finance’s Fiscal Information Agency or tax authorities regarding various types of income and property).
    (2) Employment certificate issued by the employer, or a written statement by the applicant explaining job content and income.
    (3) Certificates of professional occupation, technical qualifications, or skills issued by government agencies of the Republic of China. (If the supporting documents belong to a spouse, the spouse’s parents, or one of the parents residing in Taiwan, such persons shall also provide a letter of guarantee sufficient to ensure the applicant’s livelihood in Taiwan.)
    (4) Other documents sufficient to prove the applicant can be self-supporting or has no concerns regarding livelihood security.
  4. For minors, a consent letter from the legal representative.
  5. Other relevant household registration or identity documents (such as a copy of the certificate of approval for loss of nationality).
  6. One front-facing, color, bareheaded photograph taken within the past two years (same specifications as the National Identification Card photo, with name written on the back).
  7. Certificate fee of NT$1,200. (Please pay by postal money order payable to the Ministry of the Interior.)

※ Documents produced abroad shall be authenticated by ROC overseas missions and re-verified by the Ministry of Foreign Affairs; documents produced domestically by foreign embassies, consulates, or authorized institutions shall be authenticated by the Ministry of Foreign Affairs. Documents in foreign languages shall be accompanied by a Chinese translation authenticated by ROC overseas missions and re-verified by the Ministry of Foreign Affairs or notarized by a domestic notary public.
