How to Apply for Divorce Registration?

Applicants
1. Mutual Consent Divorce:
(1) Both parties involved.
(2) Authorized representative: with justifiable reason, approved by the Household Registration Office.

2. Divorce by Court Judgment, Court Mediation, or Court Reconciliation:

  • One party may apply. (If neither applies, an interested party may submit the application.)

Required Documents

  1. Divorce Agreement (signed or sealed by two or more witnesses), Divorce Judgment and Certificate of Finality (original), Mediation Record or Reconciliation Record.
  2. Household Registration Book of both parties, National Identification Card (foreigners with passport or identity documents), signature (or seal), one recent front-facing half-length color photo taken within the last 2 years or a digital photo, and a fee of NT$50 each. Exemptions for submitting photos or digital images are as specified in Article 14 of the Regulations on Establishment and Management of ID Card and Household Registration Photo Files.
  3. Divorce documents with Mainland China residents (including authorization letters) must be verified by the Straits Exchange Foundation; court judgment divorces must be approved by a court decision.
  4. Foreign divorces: the documents and translations must be verified by a Taiwanese embassy/consulate or a government-recognized agency. Divorce agreements with annotation “in accordance with the law of the place of act” may be processed unilaterally. If in a foreign language, a Chinese translation must be attached and certified by an overseas office, the Ministry of Foreign Affairs Bureau of Consular Affairs, or a court. If handled by an authorized representative, the authorization letter must also be verified by the overseas office.
  5. With justifiable reason, approved by the Household Registration Office, authorization is allowed. Attach the authorization letter and the ID card, signature (or seal) of the authorized representative.

Precautions

  1. Divorce of minors requires consent from the legal guardian.
  2. Mutual consent divorces must be registered at the Household Registration Office to take effect.
  3. Divorce registration based on court judgment (mediation or reconciliation) will be registered by the Household Registration Office if the parties fail to apply after being notified, pursuant to Article 48-2 of the Household Registration Act.

Household Registration Offices Handling Applications

  1. If one or both parties currently or previously had household registration in Taiwan and divorce occurs in Taiwan, the registration may be handled at any Household Registration Office.
  2. If one or both parties currently or previously had household registration in Taiwan and divorce occurs abroad, submit relevant documents to a Taiwanese embassy/consulate, representative office, or office (hereinafter “overseas office”), or institutions established/appointed by the Executive Yuan in Hong Kong or Macau, or entrusted private organizations for verification. After verification, the documents are forwarded to the household registration office at the registered domicile or last registered domicile, or you may personally register at any Household Registration Office.
  3. If neither party has ever had household registration in Taiwan and divorce occurs in Taiwan, the registration may be handled at any Household Registration Office. If divorce occurs abroad, submit relevant documents to the overseas office or institutions established/appointed by the Executive Yuan in Hong Kong or Macau, or entrusted private organizations for verification, then forward to the household registration office designated by the central competent authority or personally register at any Household Registration Office.

★ Consultation Unit: Any Household Registration Office nationwide
