Why are foreign nationals (including foreign spouses) required to possess basic language proficiency and fundamental knowledge of citizens’ rights and obligations when applying for naturalization in the Republic of China (Taiwan)? How can they obtain the related certification documents?
Possessing any one of the following documents is sufficient to demonstrate basic language proficiency and fundamental knowledge of citizens’ rights and obligations in Taiwan:
- Proof of having studied for more than one year at any public or private school at any level in Taiwan.
- Proof of class hours from courses offered by government agencies in Taiwan (including courses organized, commissioned, or subsidized by government institutions, organizations, or schools):
- General naturalization applicants (applying under Article 3, Paragraph 1 of the Nationality Act): Proof of 200 hours or more.
- Special naturalization applicants: Proof of 72 hours or more, including:
- Spouses of ROC nationals.
- Spouses of ROC nationals who divorced due to domestic violence and have not remarried; or whose spouse passed away and have not remarried but can demonstrate continued interaction with the deceased spouse’s relatives, with the marriage lasting over two years (the interaction requirement may be exempted).
- Individuals who have the fact of supporting, exercising rights and obligations for, or maintaining contact with their ROC-national minor or legally incapacitated children.
- Applicants under Article 3 Paragraph 1, Article 4 Paragraph 1, or Article 5 of the Nationality Act who are aged 65 or above.
- Other special naturalization applicants: Proof of 100 hours or more, including:
- Those whose father or mother is or was an ROC national.
- Adopted children of ROC nationals.
- Individuals born within ROC territory.
- Guardians or assistants of ROC nationals.
- Individuals born in ROC territory whose father or mother was also born in ROC territory.
- Individuals who have legally resided continuously within ROC territory for more than ten years.
Applicants who participate in and pass the naturalization test for basic language proficiency and fundamental civic knowledge may obtain a certificate (the test includes 20 oral and 20 written questions, each worth 5 points, total score 100 points):
- General naturalization applicants (under Article 3 Paragraph 1 of the Nationality Act): Passing score is 70 or above.
- Special naturalization applicants: Passing score is 60 or above, including:
- Spouses of ROC nationals.
- Spouses divorced due to domestic violence and have not remarried; or whose spouse passed away and have not remarried but can demonstrate continued interaction with the deceased spouse’s relatives, with the marriage lasting more than two years.
- Individuals supporting or exercising rights and obligations over ROC-national minor or legally incapacitated children.
- Individuals whose father or mother is or was an ROC national.
- Adopted children of ROC nationals.
- Individuals born within ROC territory.
- Guardians or assistants of ROC nationals.
- Individuals born within ROC territory whose father or mother was also born within ROC territory.
- Individuals who have legally resided in ROC territory for more than ten consecutive years.
- Other special naturalization applicants (those applying under Article 3 Paragraph 1, Article 4 Paragraph 1 or Article 5 and are aged 65 or above): Passing score is 50 or above.
